The suit, which accuses Gabehart of orchestrating a "brazen scheme" to illicitly acquire proprietary data from JGR while simultaneously negotiating his departure and a potential role with Spire Motorsports, has prompted a swift and unequivocal response from the former competition director.

The legal action, initiated by Joe Gibbs Racing, claims that Gabehart, in his capacity as competition director for the 2025 season, created a dedicated folder labeled "Spire" within his JGR systems. This folder, according to the lawsuit, was then used to synchronize confidential and proprietary information with his personal Google Drive account. JGR further alleges that Gabehart engaged in the act of photographing sensitive documents with his personal cell phone and subsequently uploading this data to his private online storage. The lawsuit specifically points to a day when Gabehart allegedly continued to access these files, even on the same day he held a meeting with Spire Motorsports co-owner Jeff Dickerson.

Joe Gibbs Racing contends that the organization became aware of discussions concerning Gabehart’s potential transition to Spire Motorsports, where he was reportedly being considered for the position of Chief Motorsports Officer. The team asserts that a third-party forensic examination provided the crucial evidence supporting their claims.

The lawsuit outlines JGR’s legal claims, which include violations of the federal Defend Trade Secrets Act, North Carolina’s trade secret laws, statutes governing unfair trade practices, and a breach of contract. "Yesterday afternoon, Joe Gibbs Racing filed a lawsuit claiming – falsely – that I shared JGR confidential information with Spire Motorsports and/or other unnamed third parties," Gabehart stated. "I feel compelled to speak out today and forcefully and emphatically deny these frivolous and retaliatory claims."

Gabehart further elaborated on the forensic examination process, asserting that Joe Gibbs Racing declined an offer to conduct a similar review of Spire Motorsports’ systems. "I look forward to the opportunity to demonstrate to the Court that I have not shared JGR’s confidential information with anyone," Gabehart’s statement continued. "In fact, I have already demonstrated that to JGR. A third-party forensic expert retained by JGR recently examined my laptop, cell phone and personal Google Drive and found no evidence to support the baseless allegations in JGR’s lawsuit. We even offered JGR the opportunity to do a similar review of Spire’s systems. JGR refused that offer and filed this spiteful lawsuit instead."
